Organization listened to 709 children, together with experts for the construction of a document that defines how the Convention on the Rights of Children and Adolescents applies to the digital environment

Imagine having a wide-ranging international debate on women's rights and creating rules and laws for states without the participation of the female public. “What would the feminist movement say about this? For a long time, adults, even with the best intentions, have discussed the rights of children and adolescents without listening to them ”, says Luis Ernesto Pedernera Reyna, chairman of the United Nations (UN) Committee on the Rights of the Child. Since 2014, the organization has been working hard to change this reality. More than 709 children 29 countries were heard, together with experts and civil society organizations, for the construction of General Comment no. 25, launched last week, which defines how the Convention on the Rights of Children and Adolescents applies to the digital environment. And that will promote changes in the way states and companies manage business in the area of ​​technology.

The document explains that the business sector, including non-profit organizations, directly and indirectly affects children's rights in the provision of services and products related to the virtual environment. Therefore, it is up to companies to respect the rights of children and prevent and remedy abuse in the digital world. “The legislation must include strong safeguards, transparency, independent oversight and access to remedial measures. States parties must demand the integration of privacy by design in digital products and services that affect children ”, guides the document. In practice, this means that websites need, the beginning, to consider children's right to privacy.

“The internet is a great socialization medium. States must think about having adequate educational content that promotes child development. There is no use in Facebook, Google and YouTube having terms of use over 13 years. Children are present on the platforms. Therefore, the right of the child by design. This means that already in development, these services have to think about children who will be direct or indirect users ”, explains Pedro Hartung, legal coordinator of the NGO Instituto Alana.
